Mike Oleinik’s success as a patent lawyer is not simply due to his immersive knowledge of the law, persuasive advocacy, and business savvy. While Mike has all of those indispensable qualities, what makes him so effective in his work securing, protecting, and monetizing valuable intellectual property assets is his deep, hands-on understanding of the technologies at the heart of those assets. Combining technical know-how with an ability to make abstract and dense scientific concepts comprehensible, Mike has amassed an impressive record of successful results for his clients in patent prosecutions, litigation, and transactional matters.
A talented electrical engineer who thrives as much in the lab as he does in the courtroom or at the negotiating table, Mike focuses his work on a broad spectrum of advanced technologies, including artificial intelligence and machine learning, integrated circuits, wireless network technologies (4G, 5G, “6G,” Wi-Fi), enterprise software, quantum computers, semiconductor fabrication, microprocessor architecture, robotics, 3-D printers, video processing, audio compression, flat panel displays, cryptography, computer operating systems, medical devices, electric and driverless vehicles, optical antennas, and security systems.
Mike has over two decades of extensive and diverse experience handling every aspect and phase of the patent lifecycle. He has spearheaded countless domestic and international patent prosecutions, preparing meticulous applications designed to neutralize potential challenges and secure the broadest rights possible. His ability to work closely, collaboratively, and efficiently with in-house engineering teams and other internal constituencies, all of whom value Mike’s professional expertise and personable demeanor in equal measure, make him particularly well-suited to his role.
When his clients’ rights need to be asserted or defended in litigation or other proceedings, Mike leverages his formidable advocacy skills to parry any threats and secure favorable, enduring outcomes. He has served as lead counsel in patent, copyright, and trademark cases in federal courts and before the USPTO, the U.S. International Trade Commission, and the Federal Trade Commission, and has conducted or defended hundreds of fact and expert depositions. Mike has a particular talent for translating the language of engineering and the language of the law into clear, understandable narratives for judges and juries, which facilitates positive resolutions, whether through settlement or verdict.
Mike’s business-focused, pragmatic patent counseling includes a wide range of efforts to maximize the value of patent assets through licensing and other strategic transactions. Leveraging his extensive experience representing technology companies throughout the Pacific Rim, he negotiates and prepares IP license agreements, asset transfer agreements, and commercial agreements, conducts thorough IP transactional due diligence, manages and counsels on patent portfolios, and drafts product clearance and freedom to operate opinions.
